What is a non-capital offense in Virginia?
Non-capital offense means a crime such as murder or cheating of one’s country that is treated so seriously death may be considered an appropriate punishment. Section criminal code, states that one commits non-capital murder in circumstances not included under capital murder. A person who is punished of a crime of non-capital murder is responsible to imprisonment for life but may be sentenced to death if he has a before the punishment of murder committed on another occasion or another punishment of murder committed on the same occasion with which he is charged. However, such a person shall not be sentenced to death as a result of a previous punishment is intended to prove against him and also if it is admitted by him or found to be proven against him by the judge. Every person who attempts to commit a crime which is a noncapital felony shall be punished as follows;
(1. If the felony attempted is punishable by a maximum punishment of life imprisonment or a term of years in excess of twenty years, an attempt thereat shall be punishable
(2. If the felony attempted is punishable by a maximum punishment of twenty years’ imprisonment, an attempt thereat shall be punishable
(3. If the felony attempted is punishable by a maximum punishment of fewer than twenty years’ imprisonment, an attempt thereat shall be punishable
